Terms & Conditons
These Terms and Conditions govern bookings with Odyssey Adventures Ltd, trading as Scottish Odyssey.

1. General
1.1 These Terms and Conditions, together with any written information provided to you before booking confirmation, form the entire agreement between you and Odyssey Adventures Ltd, trading as Scottish Odyssey (“we”, “us”, “our”).
1.2 We aim to keep information and prices accurate across our website and other materials. Errors can occur. We reserve the right to correct inaccuracies, omissions or pricing errors at any time without liability.
1.3 Photographs or video captured by our staff or representatives during tours may be used for marketing. If you do not wish to appear, please notify us in writing before your tour or advise your guide at the start. We will take reasonable steps to respect your preference.
1.4 Website content, itineraries, pricing and services may be updated at any time at our discretion.
2. Bookings and Reservations
2.1 You may book online, by phone or in person.
2.2 A booking is confirmed when we receive a deposit or full payment (as applicable) and issue a confirmation email with your reservation number.
2.3 Your confirmation will include your reservation number, any outstanding balance and any next steps required.
3. Payment
3.1 Unless stated otherwise, full payment is required at the time of booking.
3.2 We accept payment by credit or debit card, bank transfer and any other methods listed on our website.
3.3 If a payment fails or a cheque is returned, you are liable for associated bank fees and the booking may be cancelled until cleared funds are received.
4. Changes and Cancellations by the Company
4.1 We will make every effort to deliver the itinerary and services as described. Unforeseen circumstances – including adverse weather, safety concerns, landslides, road closures or similar – may require changes. We will inform you as soon as possible and offer suitable alternatives.
4.2 We may cancel tours that do not reach the minimum participant number. In that case, our liability is limited to a full refund of monies paid or an agreed alternative tour.
4.3 We are not responsible for costs or penalties relating to independent travel arrangements you make, such as flights, accommodation or transfers, that are affected by a change or cancellation.
4.4 If a tour guide becomes unavailable due to illness or other unforeseen reasons, we will endeavour to provide a suitable replacement or offer an alternative date.
5. Changes and Cancellations by the Customer
5.1 Cancellations must be made in writing to us if booked directly, or via the authorised agent if booked through an agent. Agents may levy their own fees.
5.2 Upon receipt of written notice, the following charges apply based on the time before the tour start date:
Single Day Tours:
- More than 30 days – full refund
- 15–30 days – 50% cancellation fee
- 7–14 days – 75% cancellation fee
- Less than 7 days – no refund
Multi Day Tours:
- More than 60 days – full refund
- 60–30 days – 50% cancellation fee
- 30–14 days – 75% cancellation fee
- Less than 14 days – no refund
5.3 Excursions and guide overnight fees are non-refundable.
5.4 You may request to re-arrange your tour for no fee once within the 50% cancellation fee period, but Scottish Odyssey reserve the right to not re-arrange based on availability.
5.5 To request changes or cancellations, contact us by phone or email.
6. Limitation of Liability
6.1 Outdoor activities involve inherent risks. We implement reasonable safety measures, yet accidents can occur. By booking and participating you accept these risks and agree we shall not be liable for loss, damage, expense or injury except where caused by our negligence. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud or any other liability that cannot be excluded under UK law.
6.2 Some activities – including kayaking, stand-up paddleboarding, canoeing, abseiling, climbing, quad biking and axe throwing – are delivered by specialist third-party partners. Participation may require signing their waiver and agreeing to their terms. During such activities, the partner’s liability and insurance apply.
6.3 You are responsible for ensuring you and your party are physically able to participate in the activities and conditions associated with your booking.
7. Special Requests
7.1 Please advise special requests at the time of booking. We will endeavour to meet them, although they cannot be guaranteed. Failure to fulfil a request does not constitute a breach of contract.
8. Behaviour and Code of Conduct
8.1 Respect for our staff, other guests, local communities, vehicles, equipment and facilities is required at all times.
8.2 Abuse, antisocial behaviour or damage caused by negligence may result in removal from the tour. You may be charged for repair or replacement where applicable.
8.3 Alcohol consumption is not permitted during tours unless it forms part of the itinerary. Disruptive behaviour can lead to immediate removal and cancellation of future bookings without refund.
9. Complaints
9.1 Raise any issues with your guide as soon as possible so we can seek a prompt resolution.
9.2 If unresolved, submit a written complaint within 28 days of your return and include your reservation number and full details.
10. Travel and Luggage
10.1 Each passenger may bring one suitcase or backpack (maximum 15 kg and up to 67 cm × 45 cm) plus one small carry-on bag (maximum 10 kg).
10.2 Check in at least 15 minutes before departure. We are not liable for missed services due to late arrival.
11. Governing Law
11.1 These Terms and Conditions are governed by the laws of Scotland. The Scottish courts have exclusive jurisdiction over any dispute.
Notes & Recommendations
Image consent: for identifiable individuals, UK data protection best practice is to collect consent. Your opt-out wording above helps, although an explicit tick-box at booking is advisable.
Packages: if you combine transport with other services such as accommodation so that it meets the definition of a package, the Package Travel and Linked Travel Arrangements Regulations 2018 may apply. Review product structures and disclosures accordingly.
Liability: nothing here excludes liability where UK law prohibits exclusion. The liability clause above reflects that position.
